    Do you know your rights following an accident?



    Why compromise on the quality of your vehicle repairs?

    It has been agreed with the Office of Fair Trading and The British Board Of Motor Insurers that as a Motor Vehicle insurance policy holder you have the right to choose where to have your vehicle repaired regardless of your insurance companies advice. You are not obliged to use their approved repairer and you can insist on having your vehicle repaired by a manufacturer-approved bodyshop like Malton Motors.


    What if my insurer uses an approved repairer?

    Insurance companies direct policyholders vehicles into their 'approved' repairers - a network of companies they have chosen with the aim of keeping their costs down. They also dictate the level of service and the quality of the repair you and your car will receive. Also, non original parts are frequently used which may not fit correctly and will probably invalidate your manufacturers warranty.


    Do I need to get two different estimates for the repair?

    No, estimates are not required as Malton Motors can agree repair rates with the insurance company/Motor engineer


    Am I entitled to a similar replacement vehicle, whilst mine is off the road?

    Yes if the accident was not your fault and you can prove a need for a replacement vehicle silmlar to your own. The cost of which is recoverable from the at fault party or his/her insurance company, on a credit hire basis.


    What if my vehicle is written off?

    Your vehicle may be deemed un-economical to repair, usually if the cost of repairs is more than a certain percentage of the current value of the vehicle. You may be seriously disadvantaged if your vehicle is not repaired as you may be liable for the outstanding hire purchase or leasing commitments. Very often a borderline case may be a repairable proposition if the owner ‘s wishes are for the vehicle to be repaired, repairs costs can be up to as much as the current market value. You are entitled to stay in a replacement vehicle for a period up to seven days after the write off cheque is received.


    Do I have to pay my insurance policy excess?

    No, by claiming off the at fault person’s insurance, you will not be invoking your own insurance policy and therefore will not have to pay a policy excess


    Is the length of repair increased by not using my insurance recommended repairer?

    No, although the majority of insurance approved repair shops have automatic authority to commence repairs, the difference at the end of the repair will be minimal. The reason for this is BMW bodyshops have direct access to a BMW parts department, reducing the waiting time for parts. A direct link to BMW gives immediate access for all technical specifications and safety requirements, this allows a problem free repair process.

    Yes, having your BMW repaired in a BMW bodyshop ensures the repair is carried out correctly. After the repairs you will be issued with a repair certificate, this assures your re-sale value will be protected.
